Should a defendant have legitimate reason to have engaged detectives to verify the relevant suspicions in order to improve their position during a lawsuit the costs of the detectives engaged are reimbursable.

This headnote is valid for a lawsuit concerning damages for pain and suffering after an electrical accident if there is reason for legitimate doubt that the claimant was in fact so badly injured as he claims. (here: dependent on a wheelchair, occupational invalidity)

An objective necessity is required for the engagement of several detectives to investigate the actual living circumstances of the claimant.
