„Personal need“ of an apartment is one of the reasons in tenancy law which allows the landlord to terminate the contract with the tenant. This makes it very tempting for the landlord to use a non-existent “personal need” as a pretext for terminating the contract. This is known as a “pretextual” personal need. This arises when the landlord or the party for whose benefit the contract is to be terminated does not intend to use the apartment personally.

The landlord is fully liable for damages.
