Maintenance suit
The court decides whether the use of investigative services was necessary and within proportion. This is the basis for the decision on reimbursement for the detective costs incurred.
If a husband defends himself against maintenance claims made by his wife by employing a detective to research a new circumstance (here: suspected cohabitation with a new partner) and the costs are not seen as out of proportion, the costs for detective work are seen as relevant to the lawsuit and as such are reimbursable.
